1. Introduction

These Terms and Conditions (“Terms”) govern your use of the services, products, and digital platforms operated by Prestige Luxury Rentals Pty Ltd (“Prestige Luxury Rentals”, “we”, “our”, or “us”), including:

  • Vehicle, yacht, helicopter, and private jet rentals
  • The Prestige Points rewards and loyalty program
  • All subscriptions, bookings, redemptions, and user accounts
  • All interactions through our website, mobile applications, and concierge channels

By creating an account, making a booking, or using our services, you agree to be bound by these Terms and our Privacy Policy. Separate terms may apply to our brand partners, commercial affiliates, and participating perk providers.

2. Acceptance of Terms

By accessing or using our services, you confirm that:

  • You are over the age of 18, or have appropriate parental/guardian consent if under 18
  • You have read, understood, and agree to be bound by these Terms
  • You are legally authorised to enter into this agreement on behalf of yourself or the entity you represent
  • You consent to the collection and use of your personal data as outlined in our Privacy Policy

If you do not agree with these Terms, you must not access or use our services.

3. Service Overview

3.1 Luxury Rentals

We provide access to a curated fleet of supercars, luxury yachts, helicopters, and private aircraft. Each category may have separate eligibility, insurance, usage, and security requirements. These will be outlined in your rental agreement prior to confirmation.

3.2 Prestige Points Program

Our Prestige Points program allows customers to earn points through eligible bookings, referrals, subscriptions, and other interactions. Points may be redeemed for services, perks, or partner offerings. Participation is optional and governed by additional terms within this document.

3.3 Subscriptions

Customers may subscribe to different Prestige Points membership tiers, each offering distinct benefits such as bonus points, exclusive perks, early access to promotions, or discounts.

3.4 Partner Perks

Through selected partnerships, Prestige Points members may access third-party offers. Prestige Luxury Rentals is not liable for the fulfilment or quality of external partner services unless expressly stated.

3.5 Digital Platform Access

By using our website or dashboard, you may access your account, track points, redeem rewards, and interact with other features. You are responsible for maintaining the confidentiality of your login credentials.

4. Account Creation & Eligibility

4.1 Account Requirement

To book services or participate in the Prestige Points program, you must create an account via our website, concierge, or affiliated booking channels. You agree to provide complete, current, and accurate information during registration and to keep your details up to date.

4.2 Account Types

  • Standard Account: Required for all bookings
  • Prestige Points Account: Enables access to rewards, redemptions, and tier-based benefits
  • Subscription Tier Account: Includes bonus perks, offers, and higher earning rates, depending on tier

4.3 User Responsibility

You are responsible for all activity that occurs under your account. You agree not to share your login credentials or allow unauthorised access. We may suspend or terminate your account if we detect misuse, fraudulent behaviour, or breach of these Terms.

4.4 Eligibility

  • You must be legally permitted to drive, rent, or operate the class of vehicle, vessel, or aircraft being booked
  • You may be required to verify your identity with a valid passport, driver licence, or government-issued photo ID
  • International visitors are welcome but must comply with local road and safety laws, insurance coverage requirements, and relevant aviation or marine regulations

4.5 Account Suspension or Closure

  • Found in breach of these Terms or any rental conditions
  • Engaged in abuse of our promotions, points system, or referral program
  • Suspected of fraud, impersonation, or illegal activity
  • At our discretion, if necessary to protect company operations or other users

5. Booking Terms (General)

5.1 Booking Process

Bookings can be made through our website, app, or concierge. All bookings are subject to availability and confirmation. A booking is not final until full payment (or authorised deposit) has been processed and confirmed in writing.

5.2 Payment Terms

  • Payments are processed via our approved merchant (e.g. Stripe)
  • Payment may be required in full or via an approved deposit model, depending on the asset type
  • All prices are in AUD and inclusive of GST unless otherwise stated
  • Promotional pricing or redemptions using Prestige Points are non-refundable

5.3 Cancellations & Refunds

Cancellation policies vary based on the asset (vehicle, yacht, etc.) and will be clearly communicated at time of booking. Refunds may be subject to cancellation fees or non-refundable conditions, particularly during peak seasons or limited-availability offers.

5.4 Customer Conduct

  • Operate all assets responsibly and within the legal limits of their licence or credentials
  • Refrain from driving or piloting under the influence of drugs or alcohol
  • Treat all Prestige property, staff, and partner assets with respect
  • Follow safety briefings and terms of the rental agreement for each asset

6. Asset-Specific Rental Terms

6.1 Supercar Rentals

Eligibility:

  • Minimum age: 25 years old (unless otherwise approved)
  • Valid full driver licence (held for at least 2 years)
  • Additional security checks may apply for high-performance models

Security Bond:

  • A refundable bond is required prior to vehicle handover
  • Bond amounts vary by vehicle type and risk category

Conditions of Use:

  • Vehicles must not be taken to racetracks, drag strips, or used in competitions
  • No off-road use, smoking, or pets allowed in the vehicle
  • Speed limits and road laws must be strictly followed

Liability & Damage:

  • The renter is responsible for all damage not covered by insurance
  • Excess applies in the event of an incident, regardless of fault

6.2 Yacht Charters

Eligibility:

  • Minimum age: 18 years old
  • Charters may require a qualified skipper or captain (provided by us or self-nominated subject to approval)

Security Deposit:

  • Held against damage or cleaning fees
  • Deducted only in cases of breach, damage, or misuse

Conditions of Use:

  • No overcapacity of guests beyond legal vessel limits
  • Responsible consumption of alcohol permitted; illicit substances strictly prohibited
  • Swimming and water activities are at the guest's own risk

Weather & Rescheduling:

  • In the event of dangerous weather, bookings may be rescheduled without penalty
  • Refunds for weather cancellations are issued at management discretion

6.3 Helicopter Flights

Eligibility:

  • Photo ID required for all passengers
  • Flights may be subject to weight limits and weather assessments
  • No intoxicated passengers will be permitted on board

Flight Conditions:

  • Routes and flight times are approximate and may be adjusted for safety or regulatory reasons
  • Headphones and seat belts must be worn at all times

Cancellations:

  • Weather, air traffic control, or mechanical issues may result in delayed or cancelled flights
  • If a flight is cancelled due to operator or airspace restrictions, rescheduling will be prioritised

6.4 Private Jet Charters

Eligibility:

  • Full manifest of passenger names and ID required in advance
  • Additional security screenings may apply

Conditions of Charter:

  • Flights are subject to air traffic control, weather, and mechanical clearance
  • Catering, Wi-Fi, and other services may vary by jet category

Delays & Force Majeure:

  • We are not liable for delays outside of our control, including customs delays, slot reallocation, or international airspace issues

7. Prestige Points Program Terms

7.1 Earning Points

  • Customers earn 10 Prestige Points per $1 AUD spent on eligible services (excluding GST, fees, or third-party costs unless otherwise stated).
  • Points are awarded upon successful payment and confirmed service completion.
  • Promotional campaigns, bonus events, and referral programs may offer additional point earning opportunities.

7.2 Points Value

  • Prestige Points have a base redeemable value of $0.01 per point (i.e. 100 points = $1).
  • Prestige Luxury Rentals reserves the right to apply variable redemption values based on the internal cost of the item or service being redeemed.
  • Points have no monetary value and cannot be exchanged for cash or transferred between users.

7.3 Point Expiry & Forfeiture

  • Points may expire after 12 months of inactivity unless otherwise stated.
  • If your account is terminated, suspended, or closed, all unused points will be forfeited.
  • Points earned through fraudulent or ineligible transactions may be revoked without notice.

7.4 Exclusions

  • Security bonds or damage waivers
  • Cancellations, no-shows, or penalty fees
  • External partner bookings made outside Prestige’s ecosystem
  • Bookings using fully redeemed points (i.e. 100% redemptions do not earn points)

7.5 Account Status

  • Only customers with an active, verified account in good standing are eligible to earn and redeem points.
  • Subscriptions, referrals, and loyalty tier status may affect how points are earned or used.

7.6 Abuse & Manipulation

  • Exploiting technical loopholes or duplicate redemptions
  • Coordinated self-referrals or bonus farming
  • Chargebacks, fraudulent payment attempts, or identity fraud

7.7 Program Modifications

Prestige Luxury Rentals may modify, suspend, or terminate the Prestige Points program at any time, including adjusting earn rates or redemption values, adding or removing options, or introducing tiers, caps, or promotional periods. We will provide notice via email or platform alert if any material changes are made.

8. Subscriptions & Loyalty Tiers

8.1 Subscription Tiers & Pricing

All pricing includes GST. Features are subject to availability and may vary by region.

8.2 Billing & Renewal

  • Subscriptions are billed monthly and renew automatically unless cancelled prior to the renewal date.
  • You may cancel at any time through your account dashboard. Cancellation takes effect at the end of the current billing cycle.
  • We do not offer pro-rata refunds for unused time within a billing cycle.

8.3 Member Benefits

  • Bonus Prestige Points on eligible bookings
  • Exclusive partner perks, invitations, or VIP experiences
  • Priority booking access during peak demand periods
  • Loyalty upgrades or seasonal promotional offers
  • Surprise rewards or spins through gamified features

8.4 Loyalty Status & Progression

8.5 Suspension or Termination

  • You breach any part of these Terms
  • Payment fails after multiple attempts
  • Your account is found to have misused promotions, referrals, or redemptions
  • You engage in abusive or fraudulent behaviour

9. Rewards & Redemption Rules

9.1 Redemption Value & Conversion

  • The standard redemption value is $0.01 per point (i.e. 100 points = $1 AUD).
  • Redemption value may be adjusted based on the internal cost of fulfilment to Prestige Luxury Rentals or its partners.
  • If internal cost is high, more points may be required; if low, fewer points may be required for the same benefit.

9.2 Eligible Rewards

  • Free day or weekend supercar rentals (subject to seasonal availability)
  • Complimentary upgrades or extensions on existing bookings
  • Access to partner perks such as spa treatments, luxury dining, hotel stays, or event tickets
  • Gift cards or exclusive branded merchandise
  • Spin-to-win games or prize draws for additional experiences

9.3 Redemption Process

  • Redemptions must be requested via your account dashboard or concierge.
  • Some items may require manual approval or verification of internal availability.
  • Certain high-value redemptions may require a co-payment or a refundable deposit to secure the booking.

9.4 Non-Transferability & Restrictions

  • Points are non-transferable, non-refundable, and cannot be redeemed for cash.
  • Redemption offers may be limited to certain locations, dates, or user tiers.
  • Availability may fluctuate based on stock, fleet, or partner inventory.
  • Points may not be used with third-party coupons or discounts unless explicitly approved.

9.5 Tax, Fees, & Surcharges

Some redemptions may exclude insurance coverage, security bonds or cleaning fees, booking fees, tolls or surcharges, and add-ons such as drivers, extended hours, or delivery costs. These may still be payable in full at the time of redemption.

10. Termination, Limitation of Liability & Indemnity

10.1 Termination by You

You may terminate your account at any time by:

Termination will result in account closure, forfeiture of unused Prestige Points, and loss of access to any booked perks, upcoming promotions, or unconfirmed redemptions. No refunds will be provided for partially used subscriptions, expired points, or unused referral rewards.

10.2 Termination by Us

We may suspend or permanently terminate your access without notice if you breach these Terms or any rental agreement, if fraudulent or abusive activity is suspected, for prolonged inactivity (for Prestige Points and subscriptions), or if required payment/identification is not received or is invalid. We may also discontinue or modify parts of the Prestige Points or subscription program with appropriate notice, where practical.

10.3 Limitation of Liability

  • We are not liable for indirect, incidental, or consequential damages arising from the use of our services.
  • We do not guarantee continuous, uninterrupted access to our platforms or vehicles; services may be unavailable due to maintenance or external factors.
  • For third-party redemptions or charters, we do not assume liability for fulfilment, condition, or experience unless explicitly stated.
  • Our maximum aggregate liability is limited to the amount paid by you to us in the 12 months preceding the claim.

10.4 Indemnity

You agree to indemnify and hold harmless Prestige Luxury Rentals Pty Ltd, its directors, employees, contractors, and partners from claims, losses, damages, liabilities, or legal fees arising out of your breach of these Terms or laws, misuse of our assets or platforms, inaccurate information or unauthorised access, and third-party claims related to your use. This clause survives termination.

11. General Provisions

11.1 Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.

11.2 Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that part will be severed, and the remaining provisions will continue in full force.

11.3 Changes to Terms

We reserve the right to modify these Terms at any time. Updates will be posted on our website, and where changes materially affect your rights, we will provide notice via email or in-platform message. Continued use after posting constitutes acceptance.

11.4 No Waiver

Failure by Prestige Luxury Rentals to enforce any part of these Terms does not constitute a waiver of our right to later enforce that or any other part.

11.5 Entire Agreement

These Terms, our Privacy Policy, and any individual rental agreements constitute the entire agreement between you and Prestige Luxury Rentals and supersede all prior discussions, agreements, or understandings.
